Phone call between SJMC and Chris Barringer<\/strong><\/p>\n\n\n\n

CB Prohibition notices are permanent. It\u2019s prohibiting a particular a action or operation. <\/p>\n\n\n\n

SJMC I\u2019ve heard that people are working under that excavator. Would that be a breach of that notice? <\/p>\n\n\n\n

CB Really, I mean, I\u2019m sorry, but you\u2019re wasting an awful lot of my time with this. You\u2019ve said various things about you\u2019ve been told this and you\u2019ve been told that and I\u2019ve told you before that I deal with fact and evidence. The prohibition notice states that the liebherr 984 shouldn\u2019t be used \u2018in an area where other persons may be at risk\u2019 which means other persons in the working area, the working area of the grab. <\/p>\n\n\n\n

SJMC So if the excavator was working and people were, say, within, five feet of the..<\/p>\n\n\n\n

CB The working area of the grab.<\/p>\n\n\n\n

SJMC What\u2019s the working area of the grab – roughly, is it twenty yards or two feet or\u2026?<\/p>\n\n\n\n

CB Within the working area of the grab, that is within an area of danger. <\/p>\n\n\n\n

SJMC Is that within the area the grab could reach?<\/p>\n\n\n\n

CB Yeah. Any area of danger. \u2018The working area of the grab\u2019 and that\u2019s quoting from the prohibition notice. (it\u2019s not)<\/em><\/p>\n\n\n\n

SJMC I\u2019ve reported to you what Sean Currey\u2019s told me that they\u2019ve actually been\u2026<\/p>\n\n\n\n

CB I\u2019ve followed up on all the issues that Sean Currey has raised.<\/p>\n\n\n\n

SJMC And you\u2019re satisfied that this isn\u2019t happening, that the Prohibition Notice isn\u2019t being breached?<\/p>\n\n\n\n

CB Are you suggesting that if I wasn\u2019t happy I wouldn\u2019t have done anything about it? Are you suggesting that if I was aware that something was going on that shouldn\u2019t have been I wouldn\u2019t have done something about it? I\u2019ve told you before I deal with fact and evidence.<\/p>\n\n\n\n

SJMC How do you get hold of the facts, that\u2019s what I\u2019m trying to find out?<\/p>\n\n\n\n

CB I investigate.<\/p>\n\n\n\n

SJMC Do you consider that you\u2019ve done enough investigation into this?<\/p>\n\n\n\n

CB I\u2019ve investigated any issues which have been raised concerning this company (Euromin<\/em>). You coming to me and saying that somebody else has told you something, okay, I\u2019ve investigated any issues which have been raised in relation to this company as and when they\u2019ve come along.<\/p>\n\n\n\n

SJMC I\u2019m aware of that, but you\u2019ve said it\u2019s impossible for you to be there all the time so there are limits to what you can do. If you turned up they may be able to change their practice at the time.<\/p>\n\n\n\n

CB I don\u2019t always go straight in there, you can see what\u2019s going on from the far side of the harbour.<\/p>\n\n\n\n

SJMC So as far as you\u2019re concerned you feel this prohibition notice isn\u2019t being breached?<\/p>\n\n\n\n

CB I have been there, I have looked, I have watched, I have checked as often as I can, I have also asked very specific questions of people there. As far as I am aware that prohibition notice is not being breached.<\/p>\n\n\n\n

SJMC So Sean must be mistaken in what he\u2019s saying?<\/p>\n\n\n\n

CB As I said to you before, one person says one thing and one person says another, I can only deal with fact and evidence. <\/p>\n\n\n\n

SJMC But surely a statement from someone who works there and says this is happneing on a regular basis, doesn\u2019t that count as evidence?<\/p>\n\n\n\n

CB It counts as much as evidence as what other people say is happening here.<\/p>\n\n\n\n

SJMC Statements like that are evidence presumably?<\/p>\n\n\n\n

CB I can take statements from whoever I wish to take statements from, statements are taken under oath, or can be, and can used in court. They are taken under a proper procedure, under a caution where necessary, to investigate anything of this sort.<\/p>\n\n\n\n

SJMC Do you feel you\u2019ve got enough resources to do this?<\/p>\n\n\n\n

CB I\u2019m not going to get into this. I am very busy. I\u2019ve answered the questions you\u2019ve asked me several times and I really can\u2019t say any more than I\u2019ve said already.<\/p>\n\n\n\n

SJMC Thanks very much. <\/p>\n\n\n\n

Phone call between SJMC and Sean Currey<\/strong><\/p>\n\n\n\n

SJMC You know the prohibition notice that says that you couldn\u2019t use the Liebherr 984 in an area where other persons may be at risk?<\/p>\n\n\n\n

SC It said you can\u2019t work near it but it didn\u2019t actually say how far you had to be. <\/p>\n\n\n\n

SJMC So how far were people working from it?<\/p>\n\n\n\n

SC Within one, two feet.<\/p>\n\n\n\n

SJMC How often was that happening?<\/p>\n\n\n\n

SC Frequently, I\u2019d say.<\/p>\n\n\n\n

SJMC Every week, every day?<\/p>\n\n\n\n

SC Yeah, every time we were working with it basically. It goes on every day. You\u2019re working in that sort of situation.<\/p>\n\n\n\n

SJMC I\u2019ve talked to Chris Barringer and she seems satisfied that it\u2019s not happening at all. Have you talked to Chris Barringer about this?<\/p>\n\n\n\n

SC She was supposed to be coming down but apparently she got the flu or a cold.<\/p>\n\n\n\n

SJMC So she knows about your concerns about this prohibition notice being breached?<\/p>\n\n\n\n

SC Yeah.<\/p>\n\n\n\n

SJMC Has she ever asked you for a sworn statement about it?<\/p>\n\n\n\n

SC She was supposed to be coming down but like I say she didn\u2019t show up.<\/p>\n\n\n\n

SJMC Are you saying that on a weekly basis people work within a few feet of that excavator?<\/p>\n\n\n\n

SC It\u2019s one of those things, you\u2019ve got to do to do the job. <\/p>\n\n\n\n
